1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and KindaLost ("we," "us," or "our"), concerning your access to and use of the KindaLost mobile application and website (collectively, the "Service").

By accessing or using the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. User Accounts

To access certain features of the Service, you may be required to create an account. You represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You are responsible for maintaining the confidentiality of your password and account.
  • You are at least 13 years of age (or older if required by your country's laws).

We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. We also reserve the right to suspend or terminate your account at any time for violations of these Terms.

3. AI Services and Disclaimers

KindaLost utilizes Artificial Intelligence (AI) to generate travel itineraries and recommendations. You acknowledge and agree that:

  • No Guarantee of Accuracy: AI-generated content may contain errors, inaccuracies, or "hallucinations." Locations mentioned may be closed, moved, or non-existent. Always verify critical information (opening hours, entry requirements, prices) independently.
  • Not a Travel Agency: We are a tool for planning, not a licensed travel agency. We are not responsible for booking failures, missed connections, or issues with third-party service providers suggested by the AI.
  • Safety: Travel involves inherent risks. You are solely responsible for your safely and for vetting the safety of any destination or activity suggested by the Service.

4. Payments, Subscriptions, and Refunds

Certain features of the Service may be subject to payments.

  • In-App Purchases: Purchases made within the app (e.g., Apple App Store, Google Play Store) are subject to the terms and conditions of those platforms.
  • Subscriptions: If you purchase a recurring subscription, it will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage your subscriptions in your device settings.
  • Refunds: We do not process refunds directly for purchases made through mobile app stores. Please refer to Apple or Google's refund policies.

5. Intellectual Property Rights

Unless otherwise indicated, the Service and its proprietary source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

You retain ownership of the data you input into the Service. However, by generating itineraries, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such aggregated or anonymized content to improve our Service.

6. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE ARE NOT LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER HARM THAT MAY RESULT FROM YOUR TRAVELS OR USE OF THE ITINERARIES GENERATED BY THE SERVICE. YOU TRAVEL AT YOUR OWN RISK.

7. Governing Law

These Terms shall be governed by and defined following the laws of Poland and the European Union. KindaLost and yourself irrevocably consent that the courts of Poland shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
